Definitions

For the purposes of these Terms and Conditions:

  • “Company” / “We” / “Us” / “Our” refers to Leela Greens, registered and operating from Bhopal, Madhya Pradesh, India.
  • “Client” / “You” / “Your” refers to any individual, household, or organization that engages our services or visits our website.
  • “Services” refers to all landscaping, gardening, design, hardscaping, installation, maintenance, and related services offered by Leela Greens.
  • “Agreement” refers to any written quotation, proposal, or service contract signed between Leela Greens and the Client.
  • “Site” refers to the Client’s property or location where services are to be performed.
  • “Website” refers to leelagreens.com and its subdomains.

Acceptance of Terms

By using our website, requesting a free consultation, or signing a service agreement with Leela Greens, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please discontinue use of our website and do not engage our services.

These Terms may be updated at any time. Continued use of our services or website after changes are posted constitutes acceptance of the revised Terms.

Scope of Services

Leela Greens offers the following services for residential and commercial clients across India:

  • Vertical Gardening Services
  • Landscape Irrigation System Design and Installation

  • Garden Statue and Sculpture Services
  • Civil Works and Fabrication

Free Consultation

Leela Greens offers a complimentary initial consultation and site visit. This consultation is non-binding and does not create any contractual obligation between the Client and the Company until a formal agreement is signed.

Service Customization

All services are customized based on the Client’s requirements. The final scope of work, materials, timeline, and cost shall be defined in the written proposal and agreement provided to the Client before work commences

Engagement Process

Our standard working process consists of the following stages:

  1. Site Visit: Our team inspects and analyses your site to understand its needs.
  2. Evaluation: We assess design possibilities and plan the approach.
  3. Proposal: A detailed proposal including scope, materials, timeline, and cost is presented.
  4. Agreement: A formal written contract is signed by both parties, outlining all terms.
  5. Development: Work commences as per the agreed schedule and specifications.
  6. Maintenance: Post-completion maintenance is provided for a period of 3 (three) months.

Quotations, Pricing, and Payment

Quotations

All quotations provided by Leela Greens are valid for a period of 30 (thirty) days from the date of issue, unless otherwise stated. Quotations are estimates based on information available at the time of site visit and may be revised if site conditions differ materially from what was initially assessed.

Payment Terms

Payment terms shall be specified in the signed service agreement. General payment terms are as follows:

  • An advance payment as agreed in the proposal is required before commencement of any work.
  • Subsequent payments are due at milestones specified in the agreement.
  • Final payment is due upon project completion and handover.
  • All payments are to be made via the methods specified in the agreement (bank transfer, UPI, cheque, etc.).

Late Payments

In the event of late payment, Leela Greens reserves the right to suspend work until outstanding amounts are settled. The Company shall not be liable for any delays caused by non-payment.

GST and Taxes

All quoted prices are exclusive of applicable taxes including Goods and Services Tax (GST) unless explicitly stated otherwise. GST and any other applicable government levies shall be charged as per prevailing Indian tax laws.

Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information about the site and requirements
  • Ensure unobstructed access to the site for our team during agreed working hours
  • Obtain all necessary permissions, approvals, or No-Objection Certificates (NOCs) from relevant authorities (e.g., housing society, local municipality) prior to project commencement
  • Notify Leela Greens promptly of any changes to site conditions, requirements, or access restrictions
  • Ensure the safety of the site and inform our team of any known hazards

Make timely payments as per the agreed schedule

Changes to Scope of Work

Any changes to the agreed scope of work must be submitted in writing and approved by both parties. Additional work requested beyond the original agreement will be quoted separately and may impact the project timeline and total cost. Verbal instructions or approvals will not be binding on Leela Greens.

Project Timeline and Delays

Leela Greens is committed to completing projects within the timeline specified in the agreement. However, the Company shall not be held liable for delays caused by:

  • Unforeseen site conditions or access issues
  • Weather conditions or natural events (force majeure)
  • Delays in material procurement due to supply chain disruptions
  • Changes requested by the Client after commencement of work
  • Non-payment or delayed payment by the Client
  • Government restrictions, strikes, or other circumstances beyond our control

In the event of anticipated delays, Leela Greens will notify the Client in writing with a revised timeline.

Warranty and Post-Completion Maintenance

Post-Completion Maintenance

Upon completion of each project, Leela Greens provides complimentary maintenance support for a period of 3 (three) months. This includes routine upkeep and addressing any issues directly attributable to our workmanship

Warranty on Materials

Warranties on materials, plants, artificial grass, and installed fixtures are subject to the terms provided by the respective manufacturers or suppliers. Leela Greens will facilitate warranty claims where applicable but is not independently liable for manufacturer defects beyond our workmanship.

Exclusions

The warranty and maintenance support does not cover:

  • Damage caused by the Client’s misuse, neglect, or alteration of the completed work
  • Natural deterioration of plants due to improper watering, pest infestation, or weather
  • Damage caused by third parties or events beyond the Company’s control

Intellectual Property

All landscape designs, plans, drawings, concepts, and creative works prepared by Leela Greens remain the intellectual property of the Company until full payment has been received. Upon complete payment, the design is licensed to the Client for use at the specified site only.

The Client may not reproduce, share, or sell our designs to third parties without prior written consent from Leela Greens.

Leela Greens reserves the right to photograph completed projects and use images for marketing, social media, portfolio, and promotional purposes, unless the Client objects in writing prior to project completion.

Cancellation and Refund Policy

Cancellation by Client

The Client may cancel an agreement by providing written notice to Leela Greens. Cancellation charges shall apply as follows:

  • Cancellation before site work commences: Advance payment partially or fully forfeited depending on pre-project costs already incurred (design, procurement, mobilization).
  • Cancellation after site work commences: The Client shall pay for all work completed and materials procured up to the date of cancellation, plus applicable demobilization costs.

Cancellation by Leela Greens

Leela Greens reserves the right to cancel an agreement in the event of non-payment, misrepresentation of site conditions, or circumstances beyond our control. In such cases, the Client will be refunded for any prepaid amounts less the value of work already performed.

Limitation of Liability

To the maximum extent permitted under applicable Indian law, Leela Greens shall not be liable for:

  • Any indirect, incidental, or consequential losses arising from our services
  • Loss of enjoyment, aesthetic disappointment, or subjective dissatisfaction not attributable to a breach of the agreed specifications
  • Damage to underground utilities, pipes, cables, or structures that were not disclosed to us prior to commencement of work
  • Natural events including storms, floods, drought, pest infestations, or acts of God that affect the completed landscaping

Our total liability under any agreement shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

Dispute Resolution

In the event of a dispute arising from our services or these Terms, the parties agree to:

  1. First attempt to resolve the matter amicably through direct communication within 30 days of the dispute arising.
  2. If unresolved, refer the matter to a mutually agreed mediator.
  3. If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh, India.

These Terms shall be governed by and construed in accordance with the laws of India.

Website Use

Your use of our website (leelagreens.com) is subject to the following conditions:

  • The website content is provided for informational purposes only and does not constitute a binding offer.
  • You may not use our website for any unlawful, harmful, or fraudulent purpose.
  • You may not copy, reproduce, scrape, or republish any content from our website without written permission.
  • We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice.
  • Leela Greens is not responsible for the content or practices of third-party websites linked from our site.

E-Commerce Store

Our online store (leelashop.leelagreens.com) operates under separate terms of sale. By purchasing products from the store, you agree to those additional terms, including product-specific return and warranty policies. In case of any conflict, the store-specific terms shall prevail for product purchases

Privacy

Force Majeure

Leela Greens shall not be in breach of any agreement or liable for any delay or failure to perform its obligations if such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, war, pandemic, or supply chain disruptions. In such events, the Company will notify the Client and work to resume services as soon as reasonably practicable.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a competent court, that provision shall be severed from the rest of the Terms, which shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with the signed service agreement and Privacy Policy, constitute the entire agreement between the Client and Leela Greens with respect to the subject matter herein. They supersede all prior discussions, representations, or agreements, whether written or oral.
